Terms of Use

These Terms of Use ("Terms") govern your use of AI Hairstyle: Hair Color & Cut ("AI Hairstyle", "the App", "we", "us", or "our"), developed and operated by Cuneyt Emir. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Service Description

AI Hairstyle is an artificial intelligence-powered mobile application that allows you to:

• AI Style Suggestion: Upload a selfie and let our AI analyze your face to suggest hairstyles that suit you.
• Hairstyle Try-On: Upload your selfie and a reference hairstyle photo, and the AI applies that hairstyle onto your face.
• Hair Color Change: Upload a photo with your hair visible and change the color to any of 12 preset shades or a custom color of your choice.
• Hair Length Change: Modify your hair length in a photo to any of 6 length options (Buzz Cut, Short, Medium, Shoulder, Long, Very Long).
• Style Catalog: Browse over 100 curated hairstyles organized by category (Short, Medium, Long, Curly, Updo, Bangs, Fade, Trendy) and try them on your photo.

All image modifications are generated by artificial intelligence. Results are approximations and may vary in quality, accuracy, and realism depending on input photo quality, lighting conditions, hair visibility, and the complexity of the requested style.

2. Eligibility

You must be at least 13 years old (or 16 in the EU/EEA) to use this App. By using the App, you represent that you meet this age requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account and Device

• AI Hairstyle does not require you to create an account. Your device is identified by a unique device identifier (iOS identifierForVendor).
• Your photo generation credits and purchase records are tied to this device identifier.
• If you uninstall and reinstall the App, your device identifier may change. In this case, your local data (gallery, saved images) will be lost, but your purchases can be restored using the "Restore Purchase" feature.
• You are responsible for maintaining the security of your device. We are not liable for unauthorized use of your device or credits.

4. Photo Generation Credits

4.1 Free Credit

New users receive 1 free photo generation credit upon first use. The number of free credits may change at our discretion.

4.2 One-Time Credit Packs

Prices are displayed in your local currency within the App and may vary by region. Prices may change at any time; changes do not affect already-purchased credits.

4.3 Credit Usage and Refunds

• Each successful AI generation consumes one photo credit.
• If an AI generation fails due to a server error or processing issue, the consumed credit is automatically refunded to your account.
• Purchased credit packs never expire — they remain available until used.
• Apple handles all payment processing. To request a refund, visit reportaproblem.apple.com. Apple's refund policies apply. We do not directly process refunds.

4.4 Restoring Purchases

If you reinstall the App or switch devices, you can restore your purchased credit packs by going to Settings within the App and tapping "Restore Purchase." This will restore your remaining unused credits where applicable.

5. Your Content

5.1 Ownership

• You retain full ownership of the photographs you upload to the App.
• AI-generated hairstyle images created by the App based on your inputs are yours. You may use, save, share, post, print, or otherwise distribute your generated images for any personal purpose.

5.2 License You Grant Us

By uploading a photo, you grant us a limited, temporary, non-exclusive license to:

• Transmit the photo to our server for AI processing
• Transmit the photo to our AI provider (Kie AI) for the sole purpose of generating your requested hairstyle output

This license terminates immediately upon completion of the AI generation process. We do not retain, reuse, publish, or sub-license your photos for any other purpose.

5.3 Your Responsibilities

• You must have the right to upload any photo you submit. Do not upload photos of other people without their consent.
• Do not upload photos containing illegal, obscene, abusive, or harmful content.
• You are solely responsible for how you use and share your generated images.

6. Acceptable Use

You agree NOT to:

• Use the App for any illegal, fraudulent, or harmful purpose
• Attempt to reverse-engineer, decompile, disassemble, or hack the App or its server infrastructure
• Use automated tools, bots, or scripts to access the App or generate content in bulk
• Circumvent or manipulate the credit system or rate limits
• Upload content that is illegal, obscene, threatening, defamatory, or violates the rights of others
• Resell, redistribute, or commercially exploit the App's AI generation service
• Interfere with or disrupt the App's servers, networks, or infrastructure
• Impersonate any person or entity

Violation of these Terms may result in immediate termination of your access to the App without notice or refund.

7. Intellectual Property

• The App, its design, code, UI, UX, logos, icons, and brand elements are owned by Cuneyt Emir and protected by applicable intellectual property laws.
• AI model technology is provided by third-party partners and used under license.
• The hairstyle previews, catalog images, onboarding visuals, and marketing assets within the App are our proprietary content.
• You may not copy, modify, distribute, or create derivative works based on the App itself (as distinguished from the images you generate using the App, which are yours).

8. Disclaimers

• We do not guarantee that AI-generated results will be accurate, realistic, satisfactory, or suitable for any particular purpose.
• We do not guarantee uninterrupted, error-free, or secure operation of the App or its servers.
• AI processing times may vary. We do not guarantee specific generation speeds.
• The App depends on third-party services (Kie AI, Apple, RevenueCat). Interruptions or changes to these services may affect App functionality.
• We are not responsible for any decisions you make based on AI-generated images (e.g., hair salon choices, hair coloring decisions, lifestyle changes).

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Our total liability to you for any claim arising from or related to the App shall not exceed the amount you paid to us through the App in the 12 months preceding the claim, or $50 USD, whichever is greater.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of business opportunities.
• We are not liable for any damages resulting from unauthorized access to your device or data, or from viruses or malicious software transmitted through third-party services.

10. Indemnification

You agree to indemnify, defend, and hold harmless Cuneyt Emir from any claims, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your use of the App, or your violation of any rights of a third party.

11. Termination

• You may stop using the App at any time by uninstalling it.
• We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.
• Upon termination, your right to use the App ceases immediately. Sections 5.1 (your ownership of generated images), 8, 9, 10, and 13 survive termination.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be resolved in the competent courts of Istanbul, Turkey.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App, superseding any prior agreements.
